YOUNGSTOWN, Ohio - Lawyers for the pilot accused of flying his plane too low over Stambaugh Stadium are asking for Youngstown Municipal Judge Carla Baldwin to be removed from the case.

Chris Wilkinson, 33, was charged with inducing panic, disorderly conduct and improper operation of an aircraft after allegedly flying a small plane too close to the stadium while a YSU football game was being played in September 2019.

Prosecutors say Wilkinson flew well below 1000 feet above ground level.

Wilkinson's case has been rescheduled three times so far with the trial scheduled for February 28 but the hearing was postponed.

Prior to the scheduled hearing, Wilkinson's lawyers filed a request with the Ohio Supreme Court on February 21, 2023, claiming the "oddities and occurrences unveiled in his cases have undermined defendant Christopher Wilkinson's faith and confidence that he is capable of receiving an impartial trial."

There have been a number of challenges in Wilkinson's case according to the filing including COVID-19, illnesses to a case manager and flight cancelations that kept him from making it to a November 2, 2022 court date.

According to the filing, the court issued a capias for Wilkinson after he failed to appear for that hearing. On December 16, 2022, Wilkinson appeared in front of Judge Baldwin to have the capias set aside.

Wilkinson's lawyers say every person with business before the court had their warrants set aside except for him and he was taken into custody.

According to the filing, the court set bond that prohibited Wilkinson from traveling out of the state. His lawyers say this impacted his career as a pilot for a major airline as he was not given permission to travel by the court until January 23, 2023.

Judge Baldwin has until March 15 to respond to the Affidavit of Disqualification.
