The Smith Township Road foreman is off the job after being charged with operating a vehicle while impaired.

Zachary Wagner, 31, of Alliance, has been charged with OVI stemming from an incident on February 25 at 2:46 am.

Wagner has been suspended without pay pending the outcome of his court case, according to Smith Township Trustee Larry Barnett.

According to the police report, Alliance police were notified of a man asleep behind the wheel in the drive-thru of Taco Bell.

The reports states the officer found Wagner leaning over the steering wheel with his foot on the brake and the vehicle in drive.

The police report stated Wagner had a blood alcohol reading of .107 from a portable breath test.

Wagner has a hearing scheduled for March 1 in the Alliance Court at 1 p.m.
