Gov. DeWine signs bill closing spousal rape loophole into law

A bill banning all forms of rape in Ohio has been signed by Gov. Mike DeWine.
Believe it our not, rape was technically legal in Ohio - as long as the victim was married to the perpetrator.
House Bill 161, which was signed Friday, removes legal language that exempts offenders from raping their spouse in several sections of the revised code.
An example of this includes a section of the Ohio Revised Code that stated "no person shall engage in sexual conduct with another who is not the spouse of the offender or who is the spouse of the offender but is living separate and apart from the offender."
This included when the offender got the victim drunk or drugged to impair their judgement.
The bill also closes a loophole that made child rape legal so long as the child was married to the offender.
Additionally, HB 161 allows victims to testify against their spouse.
The bill will go into effect after 90 days from the time of DeWine's filing of the legislation with the Secretary of State's office.
