Norfolk Southern seeks to dismiss parts of East Palestine School lawsuit

EAST PALESTINE, Ohio - Norfolk Southern has asked a federal court to dismiss several claims made by the East Palestine City School District in a lawsuit stemming from the February 2023 train derailment. The railroad, in a motion filed last week, argues that many of the district's demands for compensation are unfounded or lack legal standing.
The school district filed its lawsuit in April, alleging that Norfolk Southern has not fully reimbursed emergency response costs and has failed to honor promises for major community projects, including a multi-million dollar community wellness center and rebuilt athletic facilities. Superintendent James Rook publicly accused the company of "walking away" from commitments.
However, Norfolk Southern's recent filing asserts it has provided "multifaceted support" to the district, totaling over $1.1 million in donations and reimbursements for specific expenses like track repairs and parking lot damage. The company disputes the district's claims of lost tax revenue and declining student enrollment due to the derailment, citing public data that it says contradicts the assertions.
Norfolk Southern stated its regret for the derailment's impact but emphasized its need to "defend itself against unfounded accusations." The motion to dismiss will be reviewed by a federal judge.
