KINSMAN, Ohio - A former Kinsman Fire Chief had a federal judge rule in his favor Friday in a case involving the chief and an EMT giving a person Narcan.

The lawsuit was brought against Cory Van Kanegan by lawyers for Jordan Aulizio, the man who was had Narcan adminstered to him during a July 2023 arrest.

Aulizio was arrested during an incident at a Dollar General store where he was reportedly "about to pass out," according to court records. The filing details first responders asking several questions which are met with incoherent and unintelligible responses.

Medical personnel at the scene noted Aulizio had "pinpoint pupils" and that he was in no condition to walk away from the scene.

According to court records, Van Kanegan and EMTs gave Narcan to Aulizio even though he stated that he didn't want it to be administered.

Van Kanegan testified in the case that the paramedic was in charge during the incident and believed it was appropriate to give Narcan. He also said he restrained Aulizio and that Narcan isn't designed to harm the patient.

The judge ruled that it wasn't shown that Van Kanegan violated his substantive due process rights or that he acted willfully or in bad faith by helping the paramedic give Narcan. She also ruled that Van Kanegan was entitled to statutory immunity on the state law claims included.
