Tri-County Landfill, Inc.'s application for "reargument" has been denied by the Commonwealth Court of Pennsylvania, according to a news release from the Citizens' Environmental Association of the Slippery Rock Area (CEASRA).

Following a memorandum opinion on August 7, 2025, Tri-County Landfill, Inc. filed a motion for reconsideration to reverse a ruling that overturned the company's permit for its landfill in Mercer County.

The permit was denied after the landfill was deemed non-exempt from a state regulation prohibiting facilities within 10,000 feet of an airport runway.

If the permit had been approved, Tri-County Landfill, Inc. would have been allowed to intake up to 40,000 tons of waste for 24 hours a day, six days a week.

As of Wednesday, the Commonwealth Court of Pennsylvania has issued its decision, denying the company's request for oral arguments to be heard on the issue again.

According to Dan Biddle, CEASRA Media Liaison, Tri-County Landfill, Inc. now has 30 days to file an appeal with the Pennsylvania State Supreme Court, if they choose to.

If Tri-County Landfill, Inc. does decide to appeal the denial of the Commonwealth Court, then respondents Liberty Township and CEASRA will have two weeks to file their response.
