Attorneys again ask Mahoning County magistrate to allow Ursuline transfers to play football in 2025

YOUNGSTOWN Attorneys with Betras Kopp Attorneys at Law have filed an amended injunction in Mahoning County Court asking a magistrate to allow Ursuline transfer students to play football in the 2025 season following a Trumbull County judge ruling in their favor.
The amended injunction, which was filed on Thursday, restates all arguments made in the original filing, but adds the fact that Trumbull County has ruled in favor of three students who transferred to Girard and asks that the same ruling be made in Mahoning County.
This fight began on September 22, days after the Ohio High School Athletic Association (OHSAA) ruled that following the cancellation of the remainder of Ursuline High School's football season due to allegations of hazing, sexual assault and harassment, any student who transferred to another school would not be eligible to play football for the 2025 season.
The original injunction in Mahoning County was denied September 24, with the magistrate saying for the student to get an exemption, they must go through the application process laid out by OHSAA and that the court itself could not grant an exception.
The magistrate further stated that granting the request would cause harm to third parties.
The attorneys say that while an appeal process with OHSAA does exist, it must be initiated by a school official.
Following the denial, the attorneys say they reached out to Boardman High School Athletic Director Jeff Hammerton, who said he would not be filing an appeal for Ursuline transfers because OHSAA's bylaws are "unfortunate, but clear."
"Despite the absence of any meaningful process to address this unprecedented situation, the plaintiffs have nevertheless made every effort to exhaust the limited remedies to them under OHSAA's bylaws," the injunction reads.
