Former Austintown Trustee candidate subpoenas evidence in domestic violence case

AUSTINTOWN The attorney representing former Austintown Trustee candidate Emily Ciccone has asked prosecutors to hand over police bodycam video and other evidence as she pursues a self-defense claim in her domestic violence case.
Ciccone, 29, is charged with first-degree misdemeanor domestic violence stemming from an alleged September 25 altercation with her husband, Mahoning County Clerk of Courts Michael Ciccone.
A pretrial hearing is set for 1:30 p.m. Tuesday in Mahoning County Court for Ciccone, who pleaded not guilty to the charge. Her defense attorney, Frank Cassese, has filed a notice claiming self-defense.
Cassese has requested evidence from the prosecutor, including two 911 audio files and body-worn camera video from Austintown Police Department officers.
The defense has also subpoenaed electronic communications between Ciccone and Poland Township Police Patrolman Dan Superak, as well as communications between Superak and Austintown Police Sgt. Chris Collins, which took place since the alleged incident.
Ciccone, a Republican, formally withdrew her candidacy for Austintown Township Trustee after the charge was filed. She remains free on a $3,500 cash/surety bond, with a no-contact order in place regarding the alleged victim.
One week ago, Emily Ciccone filed a complaint seeking a divorce from her husband of nearly seven years. Mahoning County Judge Beth Smith has declined to hear the case, asking the Ohio Supreme Court to appoint a visiting judge.
