Former Austintown Trustee candidate domestic violence case dismissed due to lack of evidence

AUSTINTOWN The domestic violence case of a former Austintown Township Trustee candidate has been dismissed.
According to Frank Cassese, Emily Ciccone's attorney, the case against Ciccone has been dismissed due to a lack of evidence.
Ciccone had originally been charged with one count of domestic violence (M1) stemming from an alleged incident on September 25, where Ciccone was accused of injuring her husband, Michael Ciccone, who is the Mahoning County Clerk of Courts.
Ciccone pleaded "not guilty" to charges during her arraignment on September 29. Cassese has filed a notice claiming self-defense.
Ahead of the pretrial hearing on Tuesday, Cassese had requested evidence from the prosecutor, including two 911 files and body-worn camera video from Austintown Police Department officers.
Additionally, the defense has also subpoenaed electronic communications between Ciccone and Poland Township Patrolman Dan Superak, as well as communications between Superak and Austintown Police Sergeant Chris Collins, which took place since the alleged incident.
Ciccone withdrew her bid for the Austintown Township Trustee position on October 7, one week after she had pleaded "not guilty" to the misdemeanor domestic violence charge.
She was one of six candidates vying for the position in the November 4 general election.
