Warren, convenience store owners discuss settlement in nuisance lawsuit

WARREN, Ohio - Attorneys for the city of Warren and the owners of a shuttered convenience store are negotiating a potential settlement that could resolve a lawsuit filed after a fatal shooting on the property.
The City of Warren and 1409 Elm Realty, Inc. filed a joint motion Tuesday requesting a delay in a permanent injunction hearing originally scheduled for Thursday before Trumbull County Common Pleas Judge Sarah Thomas Kovoor.
According to the court filing, the parties are currently discussing a resolution to the matter and require additional time to finalize the details.
The motion, submitted by City Law Director Enzo Cantalamessa and defense attorney Thomas C. Nader, stipulates that the temporary restraining order issued Aug. 7 will remain in effect until a rescheduled hearing. This agreement ensures the Convenient Food Mart at 1409 Elm Road will remain closed during the negotiations.
The city filed the civil complaint to close the business as a nuisance following an Aug. 3 shooting in the store’s parking lot that resulted in the death of 31-year-old David Owens III. City officials previously stated the business allowed loitering and violated state liquor laws, contributing to the violence.
Savion Woodall, 23, faces murder and attempted murder charges in connection with Owens' death. Two other men, Jumal Ellis Rowe and Rayjon Ray Mcelroy, face federal charges for firearms violations related to the incident.
Thursday's hearing has been reset for January. The temporary restraining order will remain in effect until then.
