TRUMBULL COUNTY, OH - A Trumbull County Grand Jury has chosen not to charge a Vernon Township man who deputies say ran over his granddaughter, 16-month-old Kaleeha Queen, in March. 

Court documents show officials did not indict 55-year-old Calvin Barger Jr. on a felony charge of aggravated vehicular homicide with alcohol. 

Barger's family telling 21 News they are happy about the jury's decision. 

"We had to go to court and explain to them that he loves my kids," said Joe Queen, Kaleeha's father. "He's their second dad. Like I told the prosecutor, it could have happened to me. It could have happened to him. It could have happened to anybody."

"It would be like a double loss if he was charged," said Kayla Queen, Kaleeha's mother. "We lost our child. We're not getting her back, but we don't want to lose somebody that's already living. We don't want to grieve two different people and one that is actually still here with us."

Flowers, photos, and stuffed animals fill the memorial set up inside and outside the family's home. The family says the amount of community support they've received has been getting them through this tragedy.

In March, investigators say Barger had a blood alcohol level of 0.094 when he was driving a truck that struck 16-month-old Kaleeha Queen of Warren.

The child was flown to Akron Children's Hospital, where she was pronounced dead.

The Summit County Medical Examiner ruled the death as a traffic accident, saying the child died from head injuries.

Barger told deputies he had three to four drinks while working on a home improvement project with a relative.

Deputies say the toddler was playing on a swing set but got in the way of the vehicle as it pulled out.

"We're hoping that it's the end of it," Kayla Queen said. "Because this is just being drug on now. We just want to remember our baby. We don't want to keep reliving this horrible situation."
