The man allegedly involved in an officer-involved shooting in Liberty Township is now asking to plead not guilty by reason of insanity.

A motion was filed on Tuesday to file a not guilty plea by reason of insanity on behalf of suspect, 55-year-old Kevin Mallard.

Mallard is accused of shooting a man in the face, followed by returning fire to a police officer who was shooting at him in Liberty Township in June.

Previously, Mallard had requested the death penalty, but this request was denied by Girard Municipal Court Judge, Jeffrey Adler who says none of Mallard's charges made him eligible for the death penalty.

Mallard was charged with attempted murder, felonious assault with firearm specifications, carrying a concealed weapon, improper handling of a firearm in a motor vehicle and inducing panic.

Mallard is scheduled for a pretrial hearing on Tuesday, July 26 at 1:30 p.m.
