Girard man accused of shooting at couple trying to retrieve stolen plant

A Girard man is currently behind bars after police say he fired shots after a couple tried to retrieve a stolen plant from his house.
According to a report from Girard PD, police were called shortly before 7:30 p.m. Monday night in reference to a person being shot at the 200 block of Amherst Avenue.
Upon arrival, police spoke with the suspect, identified as 65-year-old Phillip Davis, who police say appeared to be intoxicated. Davis told police that two people came into his yard and police say he admitted to firing a gun.
Police placed Davis under arrest and then spoke with the two victims, a male and female, who told police they were trying to retrieve a plant that Davis allegedly stole from their yard.
The male victim says this plant was sentimental to him, as his father gave it to him before he died. He told police Davis tried to charge him money to get it back.
The male victim told police that a short altercation ensued and ended with Davis allegedly shooting at the him and his fiance. The male victim told police Davis became angry after his fiance grabbed the plant and grabbed her arm causing slight scratch marks.
When the male victim tried to intervene, Davis allegedly threatened to get his gun.
Davis told police he did not shoot at the victims, but shot directly up in the air, but the male victim claims that he had pointed the gun directly at them, and heard one shot ring out as the two fled the scene.
According to the report, police observed a shotgun in a curio cabinet next to a plastic box with a cushion where Davis had been sitting, along with a half empty bottle of liquor. Police say Davis admitted to officers that he had been drinking that night.
Davis is charged with Felonious Assault, Discharge of a Firearm on or Near Prohibited Premises and Using Weapons While Intoxicated. He was arraigned on these charges Tuesday morning.
