Just shy of 190,000 people will cash in if final approval is granted in a $600 million dollar class action settlement, which was agreed to by Norfolk Southern.

Anyone living within 20 miles of the derailment, who didn't opt out is apart of the settlement. However, that doesn't guarantee you'll get paid.

Those apart of the settlement will have to file a claim by the August 22 deadline to be eligible to receive any payment.

"Deadlines are deadlines, and they're important in a case like this because we need to take all that information and then start the process of actually calculating each class member or household's allocation of the settlement.", said Adam Gomez, an attorney representing members of the suit.

How much each person will receive depends on a slew of factors, including how close someone lives to the derailment site. Those living within a two mile radius could receive $70,000 dollars.

"Direction from the derailment site, size of the household, size of the property, presence of any confirmed chemical contamination.", Gomez added.

Attorneys would receive 162 million of the 600 million dollar lump-sum.

A final approval hearing for the settlement will take place September 25, if approved, payments would go out at the earliest by the end of the year--but any appeals by individuals in the settlement could delay the process anywhere from six months to a year.

The deadline to opt out of the class action lawsuit was July 1, which saw 173 drop out of the suit. Gomez says anyone apprehensive about 

The settlement also offers $10,000 for injuries, but accepting would alleviate the rail company of any liability for future health issues down the road. There is no requirement to accept the injury payment to receive funds for property damage

Gomez, says anyone that was apprehensive due to the injury liability, can adjust their claim, even if they've already filed one.
