Supreme Court will hear appeal of sentence for gang rape of YSU student

COLUMBUS, Ohio - The Ohio Supreme Court next week will hear arguments aimed at shortening the prison sentence of a man who was 15-years-old when authorities say he took part in the gang rape of a Youngstown State University student.
On Wednesday, the state high court takes up the case of Brandon Moore, who turned 29 this month in the Marion Correctional Institution, where he is serving a 112 year sentence.
According to court testimony, Moore abducted and robbed a 21-year-old Youngstown State University student in 2001, then drove the victim to a secluded location where he and his accomplices repeatedly raped the woman orally, vaginally and anally. After the victim was freed, she reported the license number of a car involved in the crime to police who arrested the suspects.
Moore was convicted of rape, complicity, kidnapping and aggravated robbery.
In 2002 Mahoning County Judge R. Scott Krichbaum sentenced Moore to 141 years in prison, which was later reduced to 112 years upon appeal.
Moore's attorney points to a U.S. Supreme Court decision in 2010, which held that it's unconstitutional to sentence juveniles to life without parole unless the crime is murder. He argues that his sentence is essentially life without a chance for release.
Based on the state's calculation, Moore would first be considered for release when he reaches the age of 92.
