Prosecutor says Salem funeral director 'flouts' OVI plea deal

LISBON, Ohio - A specially appointed prosecutor is objecting to a Salem funeral director's request to be released from the Columbiana County Jail before he completes a 23-day sentence for an OVI conviction.
Special prosecutor Jeffrey Jakmides on Thursday filed the objection in county municipal court after 56-year-old Robert Greenisen filed a motion requesting jail release after having served just over half of the sentence that began on September 1.
Greenisen’s attorney told the cart that incarceration is a “hardship”, for his client, claiming Greenisen is the only person running the Arbaugh-Pearce-Greenisen Funeral Home in Salem.
In his response, prosecutor Jakmides asked that Greenisen's motion for release be denied, noting that he was the minimum number of jail days for his level of OVI.
"He is not a first offender; he is a multiple offender and refused to take a blood alcohol test," Jakmides said in his objection.
"Defendant is also a multiple offender as to his driving without a license, and while under suspension. In fact, in this case, Defendant used his driving privileges to drive to the Courthouse to attempt to bribe the Judge," according to the objection.
Jakmides was referring to a bribery case pending in common pleas court filed after Greenisen allegedly left $500 in a courthouse night drop box for the judge hearing the case.
According to court documents, Greenisen intends to plead guilty to the bribery charge.
The briefly worded objection concludes with a note that the OVI sentence was based on a plea negotiated with the prosecution and defense.
"Counsel for Defendant and Defendant AGREED to this sentence. They now openly flout their agreement," wrote Jakmides.
As of Friday, judge David Stucki had not ruled on Greenisen's motion and he remained in the county jail.
