The United States Court of Appeals for the Sixth Circuit on Friday rejected the appeal argument before the court on the Danny Lee Hill case, who is on death row for the murder of 12-year-old Warren Boy Scout Raymond Fife in 1985.

The court rejected Hill's defense after the claim of the new bite-mark defense again, stating that the only issue before the court was whether Hill's proposed habeus petition, and not the previously ruled on evidence.

The full panel of the Sixth Circuit Court of Appeals, in an 11-3 decision, reversed the opinion of the three dissenting members of the court relating to the case.

The Ohio Attorney General's Office successfully argued that Hill presented a successive or second request to review evidence relating to a bite mark.

In 1986, Danny Hill was convicted of murder and sentenced to death in Ohio state court. Hill was granted habeas relief based on different reasoning, and an en banc panel of this Court vacated that opinion and denied Hill’s petition for relief.
