The father of former NFL player Desmond Marrow says he was shocked after Henry County Georgia ex-cop David Rose changed his mind and backed out of pleading guilty to a criminal charge of simple battery.

A bystander videotaped Desmond's arrest which was the result of a road rage incident in which Duane explains two young white men threw coffee at his son and yelled racial slurs.

Duane Marrow said, "They called him the N word and they also said go back to Ohio. He had not had the license plates on his truck changed yet."

Marrow adds, "A driver called police thinking Desmond's phone was a gun, but there was no  gun. My son was trying to speed up to catch the young man's vehicle to get their license plate number on video.

My son gave permission to police twice to search his vehicle and they did not find a gun because there was no gun."

Video shows Desmond's hands were cuffed. He can be heard crying out, "I'm not even doing nothing ... why are you doing this to me?"

Marrow said, "My son was telling me, dad they slammed me on my head, they did this, my tooth got knocked out. They choked me."

Officers claimed they had to use force to keep Desmond from head butting and spitting on them, but video showed none of that.

The first Internal Affairs report found officer David Rose did nothing wrong and that the officer was forced to place his hand on Desmond Marrow's neck by the way Marrow was moving.

In the video you can hear Desmond Marrow saying, "You're choking me, You're choking me." 

A second investigation uncovered by Marrow's attorney's showed critical information was withheld. Duane emphasized, "Officer Rose was actually caught on tape saying Yea, I choked that mf but I ain't going to put it on my report." 

Duane, who works for the Federal Department of Corrections said, "My son who respects police is now fearful, suffered from a concussion, has PTSD, and lost his business as a result.

"I'm  law enforcement, I love law enforcement, I respect law enforcement but we can be wrong, and when we are wrong we have to answer for that. As a minister also I feel for his wife and family."

But his actions and lie caught on tape show Rose does not have the temperament to serve alongside his brothers in blue. When police know something is wrong and do nothing and say nothing, that silence speaks volumes about who they are.

"Had the cameras not been on, he would have stood by that, and to me that type of mentality goes to that blue wall of silence that we hear about sometimes. Not all officers operate under that premise but unfortunately some do" said Morrow.

The District Attorney for Henry County, Georgia told reporters that Rose can now face other criminal charges including a felony charge and prison time if he is found guilty.

Rose's new attorney told reporters her client could not plead guilty to something that makes him a criminal. They intend to fight the charges.
