A Mahoning County woman has filed a class-action suit in federal court alleging minimum wage violations by Austintown’s Hollywood Gaming and three other venues in Ohio operated by Penn National Gaming.

Attorneys for Jessica Guerriero filed the civil action in U.S. District Court against Hollywood Casino at Mahoning Valley Racecourse, as well as Hollywood Casino Columbus, Hollywood Gaming at Dayton Raceway, and Hollywood Casino Toledo.

Guerriero, who was employed by one of the gaming facilities, is asking the court to declare the suit a class action, which would allow other current and former employees to become plaintiffs.

According to the complaint, the company deducted the cost of a gaming license from employees’ paychecks, allegedly bringing hourly pay below federal minimum hourly wages of $7.25, and state minimum wages of $8.80.

The lawsuit states that the gaming license primarily benefits the employers.  The suit says the cost of the license is $15 but does not say how often that fee is deducted from paychecks.

The suit seeks damages and unpaid wages.

The defendants have not filed an answer to the complaint.  21 News reached out to the company for comment but has yet to receive a response.
