Struthers man sentenced for fight over parking space seeks release from prison
A Struthers man sentenced to seven years in prison after an argument over a parking space is asking a judge to let him out early.
Nicholas Italiano, 29, has been brought from the Richland Correctional Institution in Mansfield, Ohio to Youngstown where he is scheduled to appear for a judicial release hearing on Wednesday.
Italiano was handed a seven-year sentence in 2019 following his conviction on one count of felonious assault.
Police say Italiano fought with a woman after he took up several parking spaces with his truck at a Market Street convenience store in Youngstown.
The woman called her fiance, who police say punched Italiano in the face.
Italiano then allegedly shot the man as he was running away.
Because a gun was used in the crime, three extra years were added to the four year sentence.
If Italiano isn’t granted early release, he is scheduled to remain in prison until 2026.
A previous motion filed by Italiano in 2020 for judicial release was denied by Mahoning County Common Pleas Judge Anthony D’Apolito.
