A group of votes have filed a petition in the Seventh District Court of Appeals to contest the results of the race for judge after Republican Candidate and current interim judge in the Struther Municipal Court Jennifer Ciccone lost to Democratic candidate James Melone.

As it stands, Ciccone had lost the race with Melone beating her by nearly 1,400 votes with her getting 44.86% of the votes compared to Melone's 55.14% of the votes. These results were certified November 16.

The petition, filed in the appeals court on Friday alleges "numerous errors, mistakes, irregularity and fraud" preventing a fair count of ballots cast, preventing some ballots from being cast, as well as other "improprieties."

"There was improper, irregular and illegal conduct on the part of election officials including but not limited to, poll workers, poll judges, poll officials, poll observers or other persons who were present at the polling locations, and the Mahoning County Board of Elections in conduct of the election and the counting of votes which prevented a correct count of votes cast in the elections," the document reads.

Court documents allege that the Mahoning County Board of Elections "failed to properly train poll workers, poll judges and other persons involved with the election."

The document goes on to accuse the Board of Elections of failing to maintain up-to-date voter records, as well as "ballot harvesting," which is described as improper handling of absentee ballots.

According to the Ohio Attorney General's website, ballot harvesting is a fourth-degree felony in Ohio.

"Anyone who possesses or delivers the absentee ballot of another person (unless a close family member), may be guilty of a Felony of the Fourth Degree, subject to a prison term of up to 18 months and/or a fine of up to $5,000," the website reads.

The Board was also accused of allowing voters outside of the jurisdiction of the Struthers Municipal Court to vote in the race for judge and counted these ineligible votes.

The document demands that the Board declare the election void and declare a vacancy for the seat of Struthers Municipal Court Judge.
