Another lawsuit filed against Lafarge landfill in Lordstown for 'noxious odors'

LORDSTOWN, Ohio - Just months after a settlement between Lordstown Construction Recovery LLC and residents living near the LaFarge Landfill in Lordstown was reached and deemed fair, a new lawsuit was filed with the same complaint as the first.
This new lawsuit, which was filed by a couple who live in a home on Newton Falls Bailey Road is once again accusing the LaFarge landfill of emitting "noxious odors and dust" that invade their property.
The lawsuit accuses Lordstown Construction Recovery LLC, who operates the landfill, of failing to sufficiently manage, collect, capture and destroy gas generated at the landfill in order to prevent odors from spreading to the homes of those who live nearby.
The suit lists several violations issued by the Ohio Environmental Protection Agency (EPA) from between February of 2020 all the way until January of 2022. A total of 14 violations are listed here.
Almost all of those violations have to do with excessive off-site emissions of hydrogen sulfide, and one of them mentions excessive emission of fugitive dust.
The lawsuit states that the couple has suffered from nausea, headaches, stomach aches and difficulty breathing due to these noxious odor and dust emissions.
Additionally, the suit says the couple is forced to remain inside their homes and refrain from outdoor activities and keep their doors and windows closed at all times.
The couple is demanding that the odor be deemed a nuisance and is demanding a trial by jury in this matter.
