Warren man loses appeal in 11th District Court after June 2023 shooting conviction

A Warren man lost his appeal to overturn his conviction, claiming the court erred in his first trial in Ohio's 11th District Court on Monday.
John Daniel, 52, lost his appeal of his February 2024 conviction, in which Common Pleas Judge Ronald J. Rice sentenced him to prison for 9 years, 9 months to 12 years, 9 months.
Daniel was involved in a shooting on June 25, 2023, in which the male victim was shot five times in the side and leg.
In his appeal, Daniel claimed the court erred in denying his motion for mistrial and allowing prosecutorial misconduct and that the evidence presented at trial did not support convictions.
11th District Judges John J. Ecklund, Mary Jane Trapp and Robert J. Patton found the defendant’s claims were without merit.
Daniel has been charged with felonious assault, domestic violence, and a weapons violation.
