WARREN, Ohio - The widow of a West Middlesex truck driver killed in a traffic accident in Brookfield earlier this year has filed a wrongful death suit.

The lawsuit was filed in Trumbull County Court on behalf of the wife of Wayne Ayers, who died a month after his semi-tractor trailer was struck by a LA-Z-BOY box truck that State Troopers say failed to yield along State Route 82 on February 24.

The box truck was being driven by Robert Arms, 38, from Tarentum, PA.

Arms and his passenger, James George, also of Tarentum, were both seriously injured according to the patrol.

The wrongful death suit alleges negligence and seeks damages from both Arms and George, as well as their employers, the truck rental agency, and LA-Z-BOY Inc.

The suit seeks punitive and compensatory damages in excess of $25,000.

Robert Arms has been charged with a misdemeanor count of vehicular homicide.

His trial is set for November 17 in the Eastern District Court of Trumbull County.
