Another court filing happened Wednesday in the long battle involving the Youngstown Chill Can Plant and its owners, M.J. Joseph Development Company and the Joseph Manufacturing Company, Inc. of Irvine, CA.

This one didn't involve the city of Youngstown or others that have sued over the stalled facility that broke ground on the city's East Side in late 2016 on the ten-acre site.

In a court filing within the Mahoning Common Pleas Court Wednesday, the attorneys that represent The Joseph Company requested the court to withdraw them as counsel for the company.

Brian Kopp and Justin Markota, attorneys with the law firm of Betras, Kopp & Markota, noted the client's intent to withdraw before filing the motion.

The rules of professional conduct allow a lawyer or law firm to withdraw if the plaintiff's case is not set for trial.

The Joseph Manufacturing Company has had multiple court hearings in recent years, after the work on the parcel stopped.

In July, MS Consultants, an engineering and architecture firm that worked with the Joseph company, filed for foreclosure for $322,907.54 owed to the firm.

In late 2022, a magistrate ordered the developer of the unfinished facility to refund $1.5 million to the city of Youngstown.
